These Terms and Conditions govern access to and use of SSLFile.com, including file uploads, file transfers, shared links, downloads, account features, storage features, paid features, password-protected transfers, secure deletion features, audit logging, retention controls, and related services. SSLFile.com is a subsidiary of Dot Coms, Inc.
SSLFile.com is designed to support secure file transfer workflows, including workflows that may involve protected health information, also known as PHI, when used by covered entities, business associates, healthcare providers, behavioral health providers, substance use treatment providers, clinics, organizations, and authorized users who are responsible for handling sensitive information.
By accessing or using SSLFile.com, creating an account, uploading a file, downloading a file, sharing a transfer link, or using any feature of the service, you agree to be bound by these Terms and Conditions. If you do not agree, you must not use SSLFile.com.
SSLFile.com provides an online secure file transfer service that allows users to upload files, create transfer links, share files with intended recipients, and permit recipients to download files. The service may include free and paid features, including file size limits, storage limits, transfer limits, password protection, expiration dates, download limits, access controls, unique user accounts, account dashboards, audit logs, retention controls, secure deletion controls, custom domains, and file management tools.
SSLFile.com may use security features intended to support secure file transfer, including HTTPS/TLS encryption during transmission, encryption at rest where files are stored, password-protected transfers, unique user identification, user-based access controls, audit logging, retention controls, secure deletion controls, account authentication, security monitoring, restricted administrative access, and other measures designed to protect the confidentiality, integrity, and availability of information handled through the service.
SSLFile.com may be used to support HIPAA-compliant file transfer workflows when the service is configured and used appropriately and when all required legal, administrative, organizational, and technical safeguards are in place. HIPAA compliance depends not only on the technology used by SSLFile.com, but also on the user’s own policies, workforce practices, access controls, authorization practices, recipient verification, minimum necessary procedures, recordkeeping, breach response procedures, and compliance obligations.
If you are a covered entity, business associate, healthcare provider, behavioral health provider, substance use treatment provider, clinic, organization, or other party subject to HIPAA and you intend to upload, transmit, receive, maintain, or store PHI through SSLFile.com, you may be required to execute a Business Associate Agreement before using the service for PHI. You are responsible for determining whether a Business Associate Agreement is required for your use of the service.
You are responsible for ensuring that your use of SSLFile.com complies with HIPAA, any applicable Business Associate Agreement, applicable federal and state privacy laws, professional obligations, organizational policies, client or patient authorization requirements, and any other legal or contractual duties that apply to your organization or the information you handle. SSLFile.com provides secure file transfer functionality, but your organization remains responsible for appropriate use of the service.
You may use SSLFile.com only if you are legally capable of entering into a binding agreement and are not prohibited from using the service under applicable law. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information, maintain current account information, use unique user accounts where required, and promptly secure your account if you believe your login credentials have been compromised.
You retain ownership of files and content you upload to SSLFile.com. By uploading files, you grant SSLFile.com a limited, non-exclusive, worldwide, royalty-free license to store, process, transmit, display, reproduce, restrict, delete, and make available your files solely as necessary to operate, secure, maintain, support, and improve the service. SSLFile.com does not claim ownership of your uploaded files.
You are solely responsible for the files you upload, transmit, share, or make available through SSLFile.com. You represent and warrant that you have all rights, permissions, licenses, authorizations, consents, and authority necessary to upload, store, transfer, and share the files you submit.
You may upload, transmit, receive, or store PHI, personally identifiable information, confidential business information, clinical records, financial information, legal information, or other sensitive content only if you are authorized to do so and only if your use of the service complies with all applicable laws, agreements, policies, and professional obligations. You are responsible for limiting uploaded information to what is necessary, verifying recipient identity, selecting appropriate security settings, and ensuring that files are shared only with authorized recipients.
You may not upload, store, transfer, share, distribute, or make available any content that is unlawful, harmful, abusive, threatening, defamatory, obscene, exploitative, harassing, fraudulent, invasive of privacy, or otherwise improper. Prohibited content includes, but is not limited to, malware, viruses, ransomware, spyware, phishing materials, credential theft tools, malicious scripts, botnet materials, stolen data, unauthorized copyrighted material, trade secret violations, illegal pornography, exploitative material, hate-based content, threats, scams, and content that violates the rights of another person or entity.
You may not use SSLFile.com to engage in spam, phishing, fraud, impersonation, extortion, harassment, unauthorized advertising, unlawful distribution, abusive bulk sharing, or any activity that harms users, third parties, SSLFile.com, Dot Coms, Inc., or the integrity of the service. You may not attempt to bypass security controls, interfere with service operation, probe or attack systems, overload infrastructure, scrape data without authorization, reverse engineer the service, or access files, accounts, systems, or data without permission.
Transfer links may allow access to uploaded files by anyone who possesses the link unless additional protections, such as passwords, expiration settings, download limits, or access restrictions, are enabled. You are responsible for deciding who receives transfer links and whether additional protection is appropriate. SSLFile.com is not responsible for unauthorized access caused by your disclosure, forwarding, publication, weak password selection, failure to enable safeguards, or mismanagement of transfer links, passwords, account credentials, or access details.
Where password protection or other access controls are available, you are responsible for selecting strong passwords, transmitting passwords separately when appropriate, verifying the identity of intended recipients, limiting access to authorized users, and avoiding disclosure of passwords or links to unauthorized persons. SSLFile.com is not responsible for access caused by weak passwords, shared passwords, compromised accounts, misdirected links, or recipient error.
Files may be subject to expiration dates, storage limits, bandwidth limits, file size limits, download limits, account limits, subscription limits, retention limits, or technical limits. SSLFile.com may delete, disable, restrict, or remove files that are expired, inactive, unlawful, abusive, harmful, infringing, associated with terminated accounts, or in violation of these Terms and Conditions. SSLFile.com does not guarantee permanent storage, permanent availability, or recovery of uploaded files. You are responsible for maintaining your own backup copies unless otherwise agreed in writing.
SSLFile.com may provide retention controls, expiration settings, deletion functions, or secure deletion controls intended to remove files from active systems when deletion is requested or triggered. Deleted files may remain temporarily in backups, logs, security records, or residual storage until ordinary backup, retention, and deletion cycles are completed. SSLFile.com may preserve files, logs, or related records where necessary for legal compliance, security investigation, abuse prevention, dispute resolution, audit support, or enforcement of these Terms and Conditions.
SSLFile.com may maintain audit logs, access logs, upload logs, download logs, transfer logs, administrative logs, deletion logs, security logs, and related records. These records may include user identifiers, IP addresses, timestamps, browser and device information, login activity, file transfer activity, access activity, download activity, deletion activity, security events, and other operational information. These records may be used to operate the service, support security, investigate incidents, respond to lawful requests, assist with compliance review, and enforce these Terms and Conditions.
SSLFile.com uses safeguards intended to support secure file transfer and service integrity. However, no internet-based service, storage system, transmission method, encryption system, or security control can be guaranteed to be completely secure. You are responsible for using strong passwords, protecting your account, using available security settings, restricting transfer links, verifying recipients, and avoiding the upload of files that require protections beyond those offered by the service or agreed in writing.
SSLFile.com may collect, process, and retain technical and operational information related to use of the service, including IP addresses, browser information, device information, operating system information, access times, referral data, upload activity, download activity, transfer activity, security logs, audit logs, error logs, and account activity. This information may be used to operate the service, secure the platform, investigate abuse, prevent fraud, enforce these Terms and Conditions, improve performance, respond to lawful requests, support compliance obligations, and protect users and the service.
Users handling PHI or other sensitive information should upload, transmit, disclose, and share only the minimum information necessary for the intended purpose. Users are responsible for determining what information is necessary, who is authorized to receive it, how long it should remain available, and what access restrictions should be applied.
Recipients are responsible for deciding whether to download files from transfer links. SSLFile.com does not verify the safety, legality, accuracy, completeness, or integrity of every uploaded file. Users should download files only from trusted senders and should take appropriate precautions before opening downloaded files.
SSLFile.com may offer paid plans, subscriptions, upgrades, or premium features. Paid services are subject to the pricing, limits, features, billing cycle, and payment terms presented at the time of purchase. You are responsible for providing accurate billing information and maintaining a valid payment method where required. SSLFile.com may suspend, downgrade, restrict, or terminate paid features if payment fails, is reversed, is disputed, or is not received.
Unless otherwise stated at the time of purchase, payments are non-refundable except where required by law or expressly approved by SSLFile.com. Features, limits, pricing, and availability may change at any time.
SSLFile.com may enforce usage limits to preserve service stability, security, and availability. These limits may apply to storage, bandwidth, upload volume, download volume, file size, transfer count, account activity, API usage, or other service functions. SSLFile.com may restrict, throttle, suspend, or terminate usage that creates excessive load, interferes with other users, abuses system resources, or creates legal, security, operational, compliance, or reputational risk.
SSLFile.com, including its name, logo, software, design, user interface, layout, graphics, service structure, features, content, and branding, is owned by SSLFile.com, Dot Coms, Inc., or their licensors and is protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, exploit, or create derivative works from the service, software, interface, branding, or proprietary materials without written authorization.
SSLFile.com respects intellectual property rights and may remove, restrict, or disable access to files or transfers alleged to infringe copyrights, trademarks, privacy rights, publicity rights, trade secrets, or other legal rights. A rights complaint should include sufficient information to identify the allegedly infringing file or transfer, the rights claimed, the complaining party’s contact information, and a statement that the complaint is submitted in good faith.
SSLFile.com may review abuse reports and may take action at its discretion, including disabling links, removing files, restricting downloads, suspending accounts, terminating accounts, preserving records, blocking access, or cooperating with lawful requests. SSLFile.com is not obligated to monitor all files or transfers but reserves the right to investigate suspected violations and enforce these Terms and Conditions.
SSLFile.com may investigate suspected security incidents, unauthorized access, account compromise, improper disclosure, system misuse, malware, abuse, or other events affecting the confidentiality, integrity, or availability of information handled through the service. Where required by law or applicable agreement, SSLFile.com will provide notifications regarding reportable breaches or security incidents involving PHI or other protected information.
SSLFile.com may rely on third-party providers and subcontractors for hosting, storage, infrastructure, analytics, payments, email delivery, security, backups, monitoring, content delivery, and other operational functions. Third-party services may be subject to their own terms, policies, limitations, outages, and security practices. When required for PHI-related services, SSLFile.com will use appropriate agreements or contractual protections with subcontractors that create, receive, maintain, or transmit PHI on behalf of SSLFile.com.
SSLFile.com may experience downtime, maintenance, interruptions, delays, upload errors, download errors, data transfer issues, or service limitations. SSLFile.com does not guarantee uninterrupted, error-free, secure, or permanent availability. SSLFile.com may update, modify, suspend, restrict, discontinue, or replace any part of the service at any time.
SSLFile.com may suspend, restrict, or terminate access to the service if you violate these Terms and Conditions, create legal or security risk, abuse the service, fail to pay applicable fees, infringe rights, interfere with service operation, or use the service in a harmful or unlawful manner. Upon suspension or termination, SSLFile.com may delete, disable, restrict, or preserve files, transfers, account data, logs, and related records as appropriate.
SSLFile.com does not sell PHI. SSLFile.com does not use PHI uploaded, transmitted, received, maintained, or stored through the service for advertising, marketing resale, data brokerage, or unrelated commercial profiling.
SSLFile.com is provided on an “as is” and “as available” basis. SSLFile.com, Dot Coms, Inc., and their owners, operators, affiliates, employees, contractors, vendors, and service providers make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, security, availability, accuracy, reliability, regulatory suitability, or compliance suitability. SSLFile.com does not warrant that files will remain available, that transfers will be uninterrupted, that unauthorized access will never occur, or that the service will meet your specific legal, clinical, organizational, or regulatory requirements.
SSLFile.com provides security features intended to support secure file transfer and HIPAA-related workflows, but use of SSLFile.com alone does not make any user, organization, workflow, disclosure, transfer, or recordkeeping practice compliant with HIPAA or any other law. Users remain responsible for their own compliance obligations, including authorization practices, workforce training, access management, minimum necessary determinations, policies and procedures, recipient verification, breach response, and required agreements.
To the maximum extent permitted by law, SSLFile.com, Dot Coms, Inc., and their owners, operators, affiliates, employees, contractors, vendors, and service providers are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages. This includes loss of files, loss of data, unauthorized access, disclosure caused by shared links, account compromise, service interruption, upload failure, download failure, regulatory consequences, compliance failures caused by user conduct, lost profits, business interruption, reputational harm, or damages arising from use of or inability to use the service.
To the maximum extent permitted by law, any total liability arising from or related to the service shall not exceed the amount paid by you to SSLFile.com during the three months before the claim arose, or one hundred dollars if no payment was made.
You agree to defend, indemnify, and hold harmless SSLFile.com, Dot Coms, Inc., and their owners, operators, affiliates, employees, contractors, vendors, and service providers from and against any claims, damages, losses, liabilities, penalties, costs, or expenses arising from your use of the service, your uploaded files, your shared links, your violation of these Terms and Conditions, your violation of law, your infringement of rights, your handling of PHI or sensitive information, your failure to obtain required authorizations or agreements, your misuse of the service, or your failure to comply with applicable privacy, security, or professional obligations.
These Terms and Conditions are governed by the laws of the jurisdiction in which Dot Coms, Inc. operates, without regard to conflict-of-law principles. Any dispute arising from or related to SSLFile.com shall be handled in the appropriate courts or dispute forum serving that jurisdiction, unless otherwise required by applicable law.
SSLFile.com may revise these Terms and Conditions at any time. Updated terms may be posted on the website with a revised effective date. Continued use of SSLFile.com after updated terms are posted means you accept the revised Terms and Conditions.
